Posting Co-Rapporteur acknowledges: Not all sectors are abusive

During a debate on free movement for workers and consequently the revision of the Posting of Workers Directive organised by Euractiv and the Mission of Switzerland to the European Union, Ceemet representative and Posting expert Delphine Rudelli was the first person to take the floor.

After her intervention Ms Rudelli triggered a reaction with MEP and Co-rapporteur Agnes Jongerius (S&D, NL) to acknowledge that not all sectors are involved in abusive practices towards employees.

Statements during the debate

  • Boris Zürcher, key note speaker and Director of the Labour Directorate at the Swiss State Secretariat for Economic Affairs (SECO) shared with the audience present (a full house) that for their free movement of labour agreement that the Swiss government has closely worked together with the social partners.
  • Séverine PicardETUC’s legal advisor, called for the enforcement of Directives and to reinforce the role of social partners and their autonomy.
  • Jordi Curell Gotor, Director Labour Mobility at DG Employment, warned that the enforcement of social provisions should not hurt the principles of free trade of services across the Union.
  • Various members of the panel expressed their support to the enforcement of rules.

Question remains

Considering the level of agreement, the question arises, why this has not been taken into consideration and why there is a 1-size-fits-it-all solution on the table? All the topics on which the panellists and Ceemet agrees are covered in Ceemet’s ‘Legal & Practical Implications’ of 2016.

After the panel debate, Ceemet remains hopeful that at the end of the Trilogue negotiations a deal will be presented including the areas where there is a common agreement.
