The Written Statement Directive has been assessed as an overall well-functioning directive. Hence, CEEMET does not see the need for a revision of this directive.
The REFIT evaluation of the Written Statement Directive should not be used as a backdoor for discussions on the introduction of a common EU definition for the notion of ‘employee’, nor to broaden the objectives of the Directive by turning it into a set of minimum employees’ rights.
The aim of the REFIT evaluation is to make EU law simpler and fit for purpose, and to reduce regulatory costs, notably by reducing the administrative burden for companies. The suggestions made by the Commission to modify the Written Statement Directive within its current objective of informing employees, will inevitably lead to an increase of costs and administrative burdens for employers.
